NEXGO Express Terms and Conditions

Please read and understand these Terms and Conditions (“Terms”) before using the www.nexgoexpress.com website and its services managed by ARCI NEXGO EXPRESS COURIER SERVICES (“NEXGO Express”, “NEXGO”, “us”, “we”, or “our”).

By registering to NEXGO Express’ services, you (“Sender”, “user”, “you”, or “your”) understand and agree to be bound by these Terms.

Definitions

1. SENDER or USER is the party with a registered NEXGO account accessing and using NEXGOs services.

2. RECIPIENT or CONSIGNEE is the party intended to receive the shipment.

3. SHIPMENTS or PACKAGES are any item, article, or commodity properly packed and sealed in any of our S-Go, M-Go, or L-Go pouches or the sender’s own packaging with a completely linked NEXLink waybill or with an attached e-waybill.

4. BUSINESS OPERATIONS are pick up and delivery of shipments from Monday to Saturday 8am to 8pm, excluding Sundays and Special Holidays. Operation process overview is “Schedule today, pick up tomorrow, and deliver the following day to addresses in Metro Manila”

5. NEXT DAY DELIVERY is the delivery of a shipment the next business operating day from the day we receive the shipment at the NEXGO Hub, excluding pick ups made on a Saturday.

6. ELECTRONIC PRINTED WAYBILLS (E-WAYBILLS) is the shipping document generated online through the sender’s NEXGO account which contains all information that represents and pertains to a specific package and is printed and attached to said the package.

7. NEXLINK WAYBILLS is the shipping document generated online through the sender’s NEXGO account which contains all information, including a linked package ID code, representing and pertaining to a specific package.

8. S-GO is NEXGO’s official small-sized unlimited weight 6.5” x 12.5” biodegradable and self-sealable plastic pouch. Each S-Go pouch comes with a package ID code that is used to link to a filled out NEXLink waybill.

9. M-GO is NEXGO’s official medium-sized unlimited weight 9.5” x 16.5” biodegradable and self-sealable plastic pouch. Each M-Go pouch comes with a package ID code that is used to link to a filled out NEXLink waybill.

10. L-GO is NEXGO’s official large-sized unlimited weight 12.5” x 18.5” biodegradable and self-sealable plastic pouch. Each L-Go pouch comes with a package ID code that is used to link to a new filled out NEXLink waybill.

11. OWN PACKAGING is any form of box or plastic that is properly sealed with an attached e-waybill and used by the sender to contain shipments that do not fit any of our official plastic pouches.

Site Use

Registration 

Upon registration to our site, users are required to input personal data relevant to the service we conduct. It is therefore assumed and expected that all personal data entered upon registration is true and is not misleading and/or fictitious.

Content Rights 

Content found in the NEXGO website, www.nexgoexpress.com, is rightfully owned and controlled by ARCI NEXGO EXPRESS COURIER SERVICES. You are prohibited to use, in any form or manner, NEXGO’s logo and content found in its website.

Termination 

Any user found guilty of excessive misuse and abuse of our services, use of misleading and fictitious personal data, or violation of any of our Terms and Conditions will receive a notice from NEXGO.

Failure to acknowledge and send a reply within a week of receiving the notice will result to termination of account.

The user may personally terminate their registered account for any reason they deem to be necessary, as long as they do not have any current pending shipments for delivery.

Service Use

NEXLink Waybill Use

It is assumed and expected that all recipient data inputted is accurate and true; any error in our service due to the user’s negligence in the input of the data is not the liability of NEXGO.

It is also understood that the user links the NEXLink waybill to the correct package ID code of the intended shipment and writes the recipient’s name on the area provided in the pouch; mistakes in our services due to the user's negligence in linking the NEXLink waybill to the package ID code is not under NEXGO’s liability.

E-Waybill Use 

It is assumed and expected that all recipient data inputted is accurate and true; any error in our service due to the user’s negligence in the input of the data is not the liability of NEXGO.

It is also required that e-waybills are properly inserted in the pouch pocket, most especially for own packaging shipments; NEXGO has the right not to accept own packaging shipments with no attached e-waybill.

Pick up Scheduling 

Upon schedule of a pick up date, NEXGO couriers will pick up packages on the chosen address on the said date.

Senders are expected to have their packages ready for pick up on the said date. Only a maximum of three consecutive failed pick ups due to sender’s reasons will be allowed and a notice will be sent after the third failed pick up.

Delivery

NEXGO will deliver all packages the next business operating day from the time the package arrives at the NEXGO hub.

Packages that arrive at the NEXGO hub on a Saturday will be delivered on Monday of the following week.

If for a particular reason a package was failed to be delivered, it shall be returned to NEXGO’s hub and will be included in the following business operating day delivery. Only a maximum of three delivery tries is allowed for each package. If the third try still results in a failed delivery, the package will be tagged to be “Returned to Sender” and must be claimed by the sender at the NEXGO hub.

Plastic Pouch Use 

User’s may request for plastic pouch packaging thru the site. Sender’s that have on hand and receive NEXGO plastic pouch are expected to use it strictly for the purposes of using NEXGO’s service.

NEXGO has the right to call to attention users that have been found to be using the plastic pouch outside of its intended use or in any act that is illegal and deemed to be detrimental to the welfare of the business.

Prohibited Items and Unacceptable Packages

Unacceptable Packages

NEXGO has the right refuse pick up of any shipment that has been identified to be under the following conditions:

● Packages using our S-Go, M-Go, and L-Go pouches that shows excessive stress on the plastic material that may lead to damages of the item inside during the course of normal handling.

● Own packaging shipments that is not using proper packaging or is not properly protected and sealed to withstand normal shipment handling and has no attached e-waybill.

● Shipments identified to contain fragile and sensitive items that is not properly sealed before it is packed into the plastic pouch.

● Shipments that have been identified to contain any of the items stated in the Prohibited Items clause.

Prohibited Items 

NEXGO prohibits the shipment of any, but not limited to, the following listed items or items that have been identified to be prohibited by the law:

● Firearms and ammunition

● Explosive materials

● Flammable materials/substances

● Illegal goods

● Hazardous materials

● Live animals

● Human and animal remains

● Infectious substances

● Blood and body parts

● Corrosive materials

● Precious metals and stones

Shipments that have been found to contain prohibited items will be put on hold at the NEXGO hub and a notice will be sent to the sender.

Insurance and Liability

Insurance Shipments 

WITH DECLARED VALUE have free insurance up to a maximum value of Php2,000. Additional insurance up to a maximum value of Php10,000 may be availed by the user and will be charged 1% of the declared value.

Shipments with NO DECLARED VALUE will not be covered by the free or optional additional insurance.

Liability 

Shipments that have NO DECLARED VALUE and has been lost or damaged due to mishandling, will be subject to a refund by NEXGO up to the extent of the shipping fee only.

Shipments that have DECLARED VALUE and has been lost or damaged due to mishandling, will be subject to a refund by NEXGO up to a maximum of Php2,000 for free insurance or Php10,000 for availed additional insurance plus shipping fee.

We will not be liable for shipments that have been lost, damaged, or misdelivered due to negligence by the user in properly packing the shipment, linking the wrong NEXLink waybill to a package ID code, attaching the wrong e-waybill to a shipment, and errors in the input of required information.

Changes to Terms and Conditions

NEXGO has the right, at our sole discretion, to modify and/or replace these Terms at any given time. If changes takes place, NEXGO will provide at least 2 business operating weeks’ notice prior to the enforcement of any new terms.
